Play Store: https://play.google.com/store/apps/details?id=ai.fastparty.mobile (“App”). The Website and the App are offered to you conditioned on your acceptance without modification of the Terms contained herein. Your use of the Website constitutes your agreement to all such Terms. For the purposes of this Policy, unless otherwise stated, all references to the Website include the Website, mobile applications, software tools, and services accessible through the Website and its affiliated platforms(collectively, the “Platforms”). “Fast Party” refers to our company, Fast Party India Private Limited, an Indian private limited company incorporated under the laws of India.  

The Website is made to provide information about Fast Party’s AI-powered event-planning platform features, the mission and history, and contact information. The Website also provides features to contact Fast Party using contact us forms. whether browsing and creating an account.

Key Definitions

“Platforms” means the digital service operated by Fast Party, including its website, mobile applications, and all associated features, tools, content, and services offered or made available by Fast Party.

“User” refers to any individual or entity who accesses or uses the Platforms, including but not limited to:
- Host: a User who creates and/or manages an event on Fast Party Platforms.
- Guest: a User who attends or participates in events or experiences via the Platforms.
- Vendor: a User who offers services, goods, or experiences through or in connection with the Platforms.

“Content” means any text, images, video, audio, data, software, code, or other material that is uploaded, submitted, transmitted, displayed, or shared on the Platforms by Fast Party or its Users.

“Personal Data” means any information relating to an identified or identifiable natural person, including but not limited to name, contact details, device information, IP address, geolocation, photographs, or any identifiers collected by or through the Platform. This includes any information defined as “personal information” or “sensitive personal data” under applicable privacy laws.

“Applicable Law” refers to all relevant statutes, regulations, directives, and rules governing the use of the Platforms, including but not limited to:
- The California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA);
- India’s Digital Personal Data Protection Act, 2023 (DPDP Act);
- The Children’s Online Privacy Protection Act (COPPA);
- Any other privacy, consumer protection, and electronic communications laws that apply based on the User’s location.
1. Privacy:
Your use of the Website is subject to Fast Party’s Privacy Policy. Please review the Privacy Policy, which also governs the Website and informs users of how we collect, use, and share your personal data.

2. Platform Modifications:
Fast Party may update or modify features of the Platforms, introduce new functionalities, or discontinue services without prior notice, except where required by law.

3. Electronic Communications:
When you visit the Website or send emails to Fast Party, you’re sending us electronic communications. By doing so, you consent to receive electronic communications- like email newsletters, transactional messages, and updates regarding our services and your account. You agree that any such communications satisfy any legal requirement that communications be in writing.

4. Acceptance of Terms:
By using or accessing our Platforms, you confirm that:

- You are at least Thirteen (13) years old.
- You have read, understood, and agree to be bound by these Terms (including anything we reference like our Privacy Policy below).
- If you use our Platforms on behalf of a company or organization, that entity accepts these Terms, and you have the authority to bind it.

5. General User Conduct:
You agree to use the Platform only for lawful purposes and in accordance with these Terms. By accessing or using the Platforms, you agree not to:

- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;  
- Upload, transmit, or distribute any content that contains viruses, malicious code, spyware, or other harmful components designed to interfere with, limit, or damage the functionality of any software, hardware, or telecommunications equipment;
- Attempt to gain unauthorized access to any portion or feature of the Platforms, or any other systems or networks connected to the Platforms, by hacking, password mining, or any other illegitimate means;
- Use any manual or automated software, devices, bots, or processes (including crawlers, data mining tools, or robots) to scrape, harvest, or access data from the Platform for any purpose without express written authorization from Fast Party;
- Engage in any unlawful, offensive, threatening, libelous, defamatory, abusive, discriminatory, harassing, or exploitative conduct against other Users, Fast Party staff, or any third party;
- Circumvent or disable any digital rights management, usage rules, or other security features of the Platform;
- Post or share content that violates the rights of third parties, including intellectual property rights, privacy rights, or publicity rights.

Fast Party reserves the right to investigate and take appropriate legal or remedial action against any violation of this section, including suspension or termination of access to the Platforms.

6. User Conduct – Minors (Aged 13+):
This section applies to users who are between 13 and 18.. By using the Platforms, you represent that you have the consent of a parent or legal guardian and agree not to:·       
- Share personal information such as your full name, address, or contact details without explicit parental consent;·       
- Engage in bullying, trolling, harassment, or abusive behavior towards other Users;·       
- Accessor post inappropriate, explicit, or harmful content;·       
- Attempt to make payments or purchases without guardian approval;·       
- Use another person’s identity or account;·       
- Interfere with platform safety measures or violate any applicable laws (such as COPPA, or DPDP);·       
- Circumvent parental control features or provide false age information.

Note: If you are under 18, Fast Party may restrict certain features and may suspend your account if parental consent is revoked.

7. User Conduct – Vendors:
This section applies to all vendors, sellers, and service providers on the Platforms. Vendors agree not to:·       
- Misrepresent their products, services, availability, or qualifications;·       
- Solicit users outside the Platforms in violation of platforms rules;·       
- Collect or process user data beyond what is necessary for the transaction, or without valid legal basis under , CCPA, or DPDP;·       
- Upload malware or unauthorized promotional material (spam, affiliate links, etc.);·       
- Engage in discriminatory or unlawful practices;·       
- Bypass payment systems mandated by Fast Party or engage in unauthorized resales;·       
- Share user personal data with third parties without the user’s consent and FastParty's approval.

Fast Party reserves the right to audit vendor compliance and terminate access for violations.

8. Jurisdictional Add-Ons:
United States (COPPA &CCPA/CPRA Compliance)

Users located in the U.S. agree not to:·       

- Submit false or misleading data under age 13 (per COPPA);·       
- Violate others’ privacy rights under CCPA by sharing personal information without consent;·       
- Disregard“ Do Not Sell or Share My Personal Information” requests, if applicable.

Note: California residents have additional rights; see our [Privacy Policy]for details.

India (DPDP Act Compliance)

Users in India agree not to:·       
- Collector process personal data without express consent of the Data Principal;·       
- Share or sell data without consent;·       
- Misuse the Platforms for unauthorized advertising or commercial messaging.

Note: Fast Party acts as a Data Fiduciary under India’s DPDP Act and offers grievance redressal as required under the law.

9. Changes to These Terms: 
We may update these Terms from time to time. When we do, we’ll post the updated Terms on the Platforms with a new “Last updated” date. Your continued use of the Platforms after we post changes means you accept those changes. If you do not agree to the updated Terms, you must stop using the Platforms. 

10. Your Account: 
If you register for an account on our Platforms (for example, as a Host, Guest, or Vendor), you are responsible for: 

- Maintaining the confidentiality of your account credentials (phone number, email and password, OTPs);  
- Restricting access to your computer or device to prevent unauthorized use; and  
- Accepting responsibility for all activities that occur under your account.

You may not assign or transfer your account or share OTPs to anyone else. Fast Party is not liable for third-party access resulting from theft or misappropriation of your login information. We reserve the right, at our sole discretion, to refuse or cancel service, terminate accounts, or remove or edit content.

11. Children Under Thirteen:
Our Platforms are intended for individuals aged Thirteen (13) and above. By using our Platforms, you represent that you are at least 13 years old. If you are between 13 and 18years old (or the age of majority in your jurisdiction), you may only use the Platforms under the supervision of a parent or legal guardian. We do not knowingly collect Personal Data from anyone under the age of 13. If you are under the age of 18, you represent that you have obtained the consent of your parent or legal guardian to use the Platforms and to provide your data to us. If we become aware that we have collected such data without verified parental consent, we will delete it promptly. Fast Party complies with COPPA (U.S.), and DPDP Act (India) regarding minor data processing.

If you believe that a child under 13 has provided personal information to Fast Party, please contact us immediately at contact@fastparty.ai.

12. Links to Third-Party Sites / Third-Party Services:
Our Platforms may include links to third-party websites or services (for example, venue partners, payment processors like Stripe or UPI, or social media plugins). Those sites are not under our control, and Fast Party is not responsible for their content, privacy practices, or any changes to them. We provide these links only as a convenience and do not imply endorsement or association.

Certain features (such as maps, payment processing, or analytics) are provided by third parties under contract with Fast Party. By using those features, you acknowledge and consent that Fast Party may share necessary data (e.g., transaction details) with those third parties so they can perform services on our behalf.

13. No Unlawful or Prohibited Use:
You are granted anon-exclusive, non-transferable, revocable license to access and use the Platforms strictly in accordance with these Terms. As a condition of your use, you agree not to use the Platforms for any unlawful purpose or in any way that violates these Terms, damage, disable, overburden, or impair the Platforms or interfere with any other user’s enjoyment of the Platforms attempt to obtain any materials or information through any means not intentionally made available by Fast Party. 

14Intellectual Property: 
All content included as part of the Website, such as text, graphics, logos, images, software code, designs as well as the compilation thereof, and any software used on the Website, is the property of Fast Party or its suppliers including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You agree that you will not reproduce, distribute, modify, create derivative works from, or otherwise exploit any Fast Party’s intellectual property in any way, including electronic, digital, or new trademark registrations by using the Platforms. Any feedback or suggestions you submit to us (“Feedback”) can be used by Fast Party without restriction or compensation.  

15.   User Content License: 
By posting, uploading, submitting, or otherwise making available any content on or through the Platforms—including but not limited to photographs, videos, written descriptions, audio recordings, event listings, feedback, usernames, and profile details (“User Content”)—you hereby grant Fast Party and its affiliates a non-exclusive, worldwide, royalty-free, fully paid-up, transferable, sublicensable, and irrevocable license to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content:·       

- for the operation, improvement, and promotion of the Platforms and related services;·       
- for internal analytics, algorithm training, or system testing;·       
- in marketing materials, advertisements, and social media in connection with Fast Party events or features, including attribution where appropriate. 

You acknowledge and agree that this license will continue even if you stop using the Platform or delete your account, subject to reasonable retention and removal practices. 

You further represent and warrant that: ·       
- You have all necessary rights, licenses, and consents to grant this license;·       
- Your User Content does not infringe upon the intellectual property, privacy, or other rights of any third party;·       
- Your User Content is not unlawful, defamatory, or otherwise prohibited under Applicable Law.·       
- To the fullest extent permitted under applicable law, you waive any moral rights or similar rights of attribution or integrity you may have in the User Content.·       
- Fast Party does not claim ownership over your User Content. You retain full ownership and any intellectual property rights in your contributions, subject to the license granted herein. 

16. Take Down Procedure for Infringement:
If you believe your IP rights are being violated, please notify us at chetana@legalcornerllp.com with the following: (a) your contact details, (b) the infringing content, and (c) proof of ownership.  

17.   International Users: 
Fast Party’s Platforms are controlled and operated from India. Fast Party Solutions India Pvt Ltd acts as a data controller/fiduciary. Users accessing from the U.S. or India have specific rights under their local privacy frameworks. If you accessor use our Platforms from any location outside India, you agree that you are solely responsible for ensuring your use of Fast Party’s content complies with all applicable laws in your jurisdiction. Your Personal Data may be transferred to, stored in, and processed on servers located in India, the U.S. or other countries. These jurisdictions may have data-protection standards that differ from your home country. Whenever such cross-border transfers occur, we rely on the mechanisms described in our Privacy Policy to ensure ongoing protection of your data. You may exercise rights available under the relevant applicable laws and subject to any exemptions or limitations. See “Your Rights and Choices” in the Privacy Policy for specific details on the same.  

18.  Governing Law and Jurisdiction:
These Terms are governed by the laws of the Republic of India and the United States (including applicable federal and state laws),each to the extent applicable based on your location and the nature of your relationship with Fast Party. You hereby consent to the exclusive jurisdiction and venue of the courts in Hyderabad, India in all disputes arising out of or relating to the use of the Platforms. Use of the Platforms is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

19.   Waiver of Jury Trial:
To the fullest extent permitted by applicable law, EACH PARTY IRREVOCABLY WAIVESANY AND ALL RIGHT TO A TRIAL BY JURY in any legal proceeding arising out of or related to these Terms, the use of the Platform, or the services provided here in. This waiver applies to any claim, counterclaim, or cause of action, whether in contract, tort, equity, or otherwise. The parties agree that any such dispute shall be resolved by a judge sitting without a jury.

20.  Arbitration:
In the event the parties are unable to resolve any dispute arising out of or relating to these Terms, or any breach thereof, whether in contract, tort, or otherwise at law or in equity, such dispute shall be resolved exclusively by final and binding arbitration. Users may opt out of binding arbitration within 30 days of accepting these Terms by notifying Fast Party in writing. The arbitration shall be conducted in English, by a single, neutral arbitrator and administered under the Arbitration and Conciliation Act of India. The seat of the arbitration shall be Hyderabad, India and the venue shall also be Hyderabad, India. The arbitrator's decision shall be final and binding, and judgment may be entered thereon in any court of competent jurisdiction. The entire dispute and the scope or enforceability of this arbitration provision, shall be determined solely by the arbitrator. The arbitration shall apply to all claims or disputes arising out of or in connection with these Terms, including tort claims, statutory claims, and privacy or consumer protection-related claims, to the extent permitted by applicable law. In any arbitration or legal proceeding related to these Terms ,the prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs. This arbitration provision shall survive the termination of these Terms.

21.  Class Action Waiver:
Any arbitration under these Terms will take place on an individual basis. Class arbitrations, collective actions, and representative proceedings are not permitted. YOU AND FAST PARTY AGREE THAT EACH PARTY MAYBRING CLAIMS AGAINST THE OTHER ONLY IN THEIR INDIVIDUAL CAPACITY AND NOT AS APLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVEPROCEEDING, INCLUDING IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of class or representative proceeding. This class action waiver applies to the fullest extent permitted by applicable law.

22.  Force Majeure:
Fast Party shall not be liable for any failure or delay in the performance of its obligations under these Terms or any disruption in the availability of the Platform that results, directly or indirectly, from events or circumstances beyond its reasonable control (“Force Majeure Events”). These include, but are not limited to:·       
- Acts of God (such as floods, earthquakes, hurricanes, or other natural disasters);·       
- Epidemics, pandemics, or public health emergencies (including COVID-19 and similar outbreaks);·       
- Acts or omissions of civil or military authorities, government regulations or orders, embargoes, or sanctions;·       
- War, terrorism, riots, or civil disturbances;·       
- Labor disputes, strikes, or shortages of materials or transportation;·       
- Cyberattacks, denial of service attacks, ransomware, data breaches, or other malicious third-party actions;·       
-Internet, hosting, or network outages; failure of telecommunications or infrastructure providers.

Fast Party will make commercially reasonable efforts to mitigate the impact of any Force Majeure Event and resume performance as soon as practicable. However, Fast Party shall not be liable for any damages, losses, or penalties arising from such delay or failure.

a. Role as a Facilitator – No Refund Liability
FAST PARTY IS SOLELY ATECHNOLOGY PLATFORM THAT FACILITATES THE DISCOVERY, HOSTING, AND PROMOTION OFEVENTS. IT DOES NOT ORGANIZE EVENTS OR COLLECT PAYMENTS ON BEHALF OF HOSTS,GUESTS, OR VENDORS. ACCORDINGLY, FAST PARTY SHALL NOT BE RESPONSIBLE FOR ISSUINGANY REFUNDS IN CONNECTION WITH EVENT CANCELLATIONS OR DISRUPTIONS CAUSED BY AFORCE MAJRE EVENT.

USERSARE ADVISED TO RESOLVE ANY REFUND, RESCHEDULING, OR COMPENSATION ISSUESDIRECTLY WITH THE RELEVANT HOST, VENDOR, OR THIRD-PARTY SERVICE PROVIDER.

b .Data Continuity
Fast Party shall use commercially reasonable efforts to maintain the integrity and continuity of its systems and user data during a Force Majeure Event. However, users acknowledge that temporary loss of access or partial data loss may occur. Fast Party disclaims liability for such disruptions, provided it has acted with reasonable care and diligence.

c. Legal Compliance and User Notification
In accordance with applicable data protection laws, including the , CCPA, and India’s DPDP Act, Fast Party will notify affected users as required in the event that a Force Majeure Event results in a material compromise of personal data. In all other cases, Fast Party will provide general updates about any Platform-wide impact via email, in-app notices, or public statements on the Platform.

d. Extended Disruption
In the event a Force Majeure Event continues for more than thirty (30) consecutive days, Fast Party may suspend or terminate the affected services or features without further liability, by providing written notice to Users.

23. Disclaimer and Indemnification:
Platform Role Disclaimer
FAST PARTY ISA NEUTRAL ONLINE PLATFORM THAT FACILITATES THE LISTING, DISCOVERY, ANDPROMOTION OF EVENTS HOSTED BY INDEPENDENT USERS, INCLUDING HOSTS, GUESTS, ANDVENDORS. FAST PARTY IS NOT THE ORGANIZER, PRODUCER, OR AGENT OF ANY EVENT ORSERVICE OFFERED THROUGH THE PLATFORM AND DOES NOT SUPERVISE, MANAGE, ORGUARANTEE THE BEHAVIOR, COMMUNICATIONS, RELIABILITY, SAFETY, LEGALITY, ORPERFORMANCE OF ANY USER OR THIRD-PARTY SERVICE.

FAST PARTY DOES NOT VERIFY THE IDENTITY,QUALIFICATIONS, LICENSING, OR LEGAL STATUS OF ANY USER OR SERVICE PROVIDER. ALLTRANSACTIONS, BOOKINGS, AND INTERACTIONS BETWEEN USERS ARE STRICTLY AT THEIROWN RISK.

Fast Party shall not be responsible or liable for:·       
- Event cancellations, postponements, or no-shows by Hosts or Vendors;·       
- Damages, injuries, losses, or disputes arising from or during any event;·       
- Any claims or liabilities arising from user-generated content or misconduct;·       
- Unfulfilled promises or services offered by any User.

Indemnification
To the fullest extent permitted by Applicable Law, each User (including Hosts, Guests, Vendors, or any other participant) agrees to indemnify, defend, and hold harmless Fast Party, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

The User’s use or misuse of the Platform;·       
- Any breach of these Terms or applicable law;·       
- The User’s event, service, or activity posted or conducted through the Platforms;·       
- Any third-party claim alleging injury, loss, or damages caused by the User’s act or omission;·       
- Any data, content, or communication submitted by the User on or through the Platforms;·       
- Any failure by the User to comply with their own independent legal or regulatory obligations.

Indemnity Claim Procedure:
Notice:
Fast Party shall notify the indemnifying User promptly in writing of any claim, demand, or action for which indemnity is sought. Delay in notice shall not relieve the User of its obligations unless such delay materially prejudices the User’s defense.

Defense and Control:  
- The indemnifying User shall have the right to assume the defense of the claim at its own expense with legal counsel reasonably acceptable to Fast Party. 
- Fast Party may participate in the defense using counsel of its choice, at its own cost.  
- If the indemnifying User fails to timely assume the defense, Fast Party may do so at the User’s expense.

Cooperation:
The parties shall reasonably cooperate in the defense and resolution of any such claim. The indemnifying User shall have access to all relevant records, information, and personnel of Fast Party for this purpose.

Settlement:

The indemnifying User may not settle any claim without Fast Party’s prior written consent if the settlement:
(a) involves an admission of liability by Fast Party,
(b) imposes any ongoing obligation on Fast Party, or
(c) does not unconditionally release Fast Party from all liability.
- Fast Party’s consent shall not be unreasonably withheld.

Reimbursement: If Fast Party incurs any costs in defending a claim before the User assumes responsibility, the User shall promptly reimburse Fast Party for such reasonable expenses.

This indemnification obligation survives termination of the User’s account and use of the Platform.

24. Liability Disclaimer:
THE INFORMATION, AI-GENERATED SUGGESTIONS,SOFTWARE FEATURES, VENDOR CONTENT, USER-GENERATED MATERIALS, AND SERVICESINCLUDED IN OR AVAILABLE THROUGH THE FAST PARTY WEBSITE OR MOBILE LICATIONS MAYINCLUDE INACCURACIES, INCOMPLETE INFORMATION, OR TYPOGRAPHICAL ERRORS. CHANGESARE PERIODICALLY MADE TO THE INFORMATION HEREIN. FAST PARTY AND/OR ITS SERVICEPROVIDERS MAY MAKE IMPROVEMENTS, MODIFICATIONS, OR UPDATES TO THE PLATFORMS ATANY TIME WITHOUT NOTICE.

FAST PARTYAND/OR ITS SUPPLIERS AND TECHNOLOGY PARTNERS MAKE NO REPRESENTATIONS ORWARRANTIES REGARDING THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS,ACCURACY, OR PERFORMANCE OF THE PLATFORMS, INCLUDING BUT NOT LIMITED TO EVENTPLANNING TOOLS, AI RECOMMENDATIONS (E.G., THROUGH ANTSY), VENDOR LISTINGS, ORRELATED GRAPHICS AND CONTENT, FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTEDBY LICABLE LAW, ALL SUCH INFORMATION, FEATURES, AND CONTENT ARE PROVIDED “ASIS,” “AS AVAILABLE,” AND WITHOUT WARRANTY OR CONDITION OF ANY KIND. FAST PARTYAND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARDTO THIS INFORMATION, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OFMERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ANDANY GUARANTEES OF OUTCOME BASED ON USER OR AI BEHAVIOR.

TO THEMAXIMUM EXTENT PERMITTED BY LICABLE LAW, IN NO EVENT SHALL FAST PARTY AND/ORITS SUPPLIERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR LICENSORS BELIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL,EXEMPLARY, OR ANY OTHER DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION,DAMAGES FOR LOSS OF USE, DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES,ARISING OUT OF OR IN ANY WAY CONNECTED WITH (A) THE USE OR PERFORMANCE OF THEPLATFORMS, (B) THE DELAY OR INABILITY TO USE THE PLATFORMS OR ANY RELATEDSERVICES, (C) THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, (D) ANYTRANSACTIONS, INTERACTIONS, OR DISPUTES BETWEEN USERS, INCLUDING BETWEEN HOSTS,GUESTS, AND VENDORS, (E) ANY RELIANCE ON AI-GENERATED OR THIRD-PARTY CONTENT,OR (F) ANY OTHER USE OF THE PLATFORMS, WHETHER BASED ON CONTRACT, TORT,NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF FAST PARTY SOLUTIONS INDIAPRIVATE LIMITED OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OFSUCH DAMAGES. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION ORLIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVELIMITATIONS MAY NOT LY TO YOU IN FULL. IF YOU ARE DISSATISFIED WITH ANY PORTIONOF THE PLATFORMS, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVEREMEDY IS TO DISCONTINUE USING THE PLATFORMS.

NOTWITHSTANDINGANYTHING CONTAINED HEREIN OR IN THE PRIVACY POLICY, IN NO EVENT SHALL FASTPARTY’S AGGREGATE LIABILITY EXCEED THE GREATER OF (A) USD 100 OR (B) THE TOTALFEES PAID BY YOU IN THE 6 MONTHS PRECEDING THE CLAIM. NOTHING IN THIS CLAUSEAFFECTS ANY RIGHTS YOU MAY HAVE UNDER LICABLE CONSUMER-PROTECTION ORDATA-PRIVACY LAWS IN YOUR JURISDICTION. 

25. Third-Party Services and Payment Processing:
Certain features of the Platform may rely on or integrate with third-party services, including but not limited to payment processors (e.g., Stripe), identity verification providers, cloud hosting services, analytics tools, communication platforms, and other vendors(“Third-Party Services”).

By using such features, you acknowledge and agree that:

1.      Independent Relationship: These Third-Party Services are operated independently and are not controlled by Fast Party. Your use of such services is governed by their separate terms and conditions, privacy policies, and applicable legal agreements. Fast Party does not endorse, control, or make any representations or warranties regarding the security, functionality, availability, or accuracy of such services.

2.      Payment Processors: If you make or receive payments through the Platform, such transactions may be processed by third-party payment service providers (e.g., Stripe). You may be required to enter into a separate agreement with such providers. Fast Party is not a party to these payment transactions, does not store or control payment credentials, and is not responsible for chargebacks, fraud, unauthorized access, or failed transactions.

3.      No Liability: Fast Party shall not be held liable for:
o  Any loss, damage, unauthorized access, data breach, or error caused by the acts or omissions of any Third-Party Service;
o  Any delay or failure in the provision of services resulting from the use or malfunction of a Third-Party Service;
o  Any disputes arising between you and such providers.

4.      User Responsibility: You are solely responsible for reviewing and complying with all applicable terms and policies of any Third-Party Service you engage with through the Platform. If you do not agree to such terms, you should refrain from using the corresponding features of the Platform.

5.      Changes: Fast Party reserves the right to change, add, or remove integrations with Third-Party Services at any time, with or without notice.

26. Termination / Access Restriction:
26.1.   Fast Party reserves the right, in its sole discretion, to suspend, restrict, or terminate your access to the Website, mobile applications, and related services, or any portion thereof, at any time and without notice, including but not limited to where you violate these Terms, misuse the Platforms, engage in fraudulent or unlawful activity, or compromise the integrity, functionality, or security of the Platforms or other users. 

26.2.   You agree that no joint venture, partnership, employment, or agency relationship exists between you and Fast Party as a result of this agreement or your use of the Platforms. Fast Party’s performance under these Terms is subject to existing laws and legal processes, and nothing in these Terms limits Fast Party’s right to comply with governmental, court, or law enforcement requests or requirements relating to your use of the Platforms or information provided to or collected by Fast Party in connection with such use. If any provision of these Terms is found to be invalid or unenforceable under applicable law (including, but not limited to, the warranty disclaimers and liability limitations above), that provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent, and the remainder of the Terms shall remain in full force and effect.  

26.3.   Unless otherwise stated, these Terms constitute the entire agreement between you and Fast Party with respect to your use of the Platforms and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Fast Party regarding the same subject matter. A printed version of these Terms and any notices delivered in electronic form shall be admissible in judicial or administrative proceedings to the same extent and subject to the same conditions as business records originally generated and maintained in printed form. It is the express intention of the parties that these Terms and all related documents be drafted and interpreted in English.
